What is the Possession Hearing?

Many landlords and indeed letting agents are concerned and worried about the procedure of tenant eviction following the expiry of the section 21 and or section 8 notice which have been served pursuant to the 1988 Housing Act (as amended Housing Act 1996).

The process for enforcing either a section 8 or section 21 notice is similar in that they involve an application to the local County Court for possession of the property (in the case of a section 21 notice) or a claim for possession of the property and a money judgement for any arrears of rent (in the case of a section 8 notice)

Once the possession claim is lodged with the County Court the Court will advise of a hearing date which will generally be four to six weeks from the date the court application was submitted. In the case of some Section 21 Claims under the accelerated procedure there is a method by which possession can be gained without the need for a court hearing.
The day of the Possession Claim hearing involves attendance to the County Court and for the parties to sit before a District Judge. The Judge will invariably ask for the parties to take the oath and to confirm various pieces of information. The Judge will have reviewed the Court file prior to the hearing and therefore be aware of the particulars of the claim.
 
The aim of the hearing is to secure possession of the property and a money judgement for any arrears of rent owed to the landlord. We at Landlord Assist have a superb record of success.
